Section 96 cpc – Appeal against decree

Section 96 CPC provides the right of appeal to the parties against the final decision of the court. If a party disagrees with a lower court’s decree, then certain decrees are challenged in a higher court. This section also provides opportunity for correction of errors committed by the court.

سیکشن 96 سی پی سی فریقین کو عدالت کےحتمی فیصلے/ڈگری کے خلاف اپیل کا حق فراہم کرتا ہے۔ اگر کسی فریق کو نچلی عدالت کے فیصلے سے اختلاف ہو، تو وہ بعض فیصلے کو اعلیٰ عدالت میں چیلنج کر سکتا ہے۔ یہ سیکشن انصاف کی فراہمی کو یقینی بناتا ہے اور عدالت کی جانب سے سر زد ہونے والی غلطیوں کو درست کرنے کا موقع فراہم کرتا ہے۔

Every decree is appeal able while
1. Consent decree
2. Compromised decree or
3. Appellate decree
is not appealable.
Original decree: The lowest court or the first court that passed the decree is called original decree. (That is appealable)
Appellate decree: the decree passed by the superior court against the original decree is appellate decree. (That is not appealable)

لیکن
کونسینٹ ڈگری یا کمپرومائزیڈ ڈگری اپیل ایبل نہیں ہوتی ۔ مطلب جب کوئی اپنی مرضی سے عدالت کے سامنے اپنا حق /رائیٹ چھوڑ دے تو اس پر اپیل نہیں ہو
گئی۔
جو لوایسٹ کورٹ /سول کورٹ ڈگری کرتی ہے اسکو اوریجنل ڈگری کہتے ہیں جبکہ اُس اوریجنل ڈگری کے خلاف جو اپیل سپیرئرکورٹ میں کی جاتی ہے اسکو اپیلیٹ ڈگری کہتے ہیں ۔
یوں اُوریجنل ڈگری کے خلاف اپیل ہو جاتی ہے جبکہ اپیلیٹ ڈگری کے خلاف اپیل موجود نہ ہے۔
