CPC Section 104 : APPEALS FROM ORDERS

Civil Procedure Code (CPC) Section 104 provides a right of appeal against certain orders passed by the court during the trial. This section deals with the interim orders which are issued during the trial of the case.

سیکشن 104 سول پروسیجر کوڈ کے تحت ان مخصوص احکامات کے خلاف اپیل کا حق دیا گیا ہے جو عدالت کی جانب سے مقدمے کی کارروائی کے دوران جاری کیے جاتے ہیں۔ یہ سیکشن ان عبوری احکامات پر توجہ دیتا ہے جو کیس کے ٹرائل کے دوران جاری کیے جاتے ہیں۔،

Points:

In this section, General rule is explained that every order of the(civil) court is not appealable.

So, here the question arises: against which orders an appeal can be filed?

Under the following sections, an appeal can be field:

1. CPC Section 35A,
2. CPC Section 47,
3. CPC Section 91 or 92
4. CPC Section 95, CPC

Thus, orders under these sections of the Civil Procedure Code can be appealed in the superior courts.

اس سیکشن میں ایک جنرل رول یہ بتلایا گیا ہے کہ سول کورٹ کے ہر آرڈر کےخلاف اپیل نہیں ہوتی ۔

تو ادھر سوال آیا کہ پھر کن آرڈرز کے خلاف اپیل ہو گی ؟

اس سیکشن میں واضع کر دیا گیا ہے کہ فلاں ۔۔۔ فلاں سیکشن کے تحت اگر عدالت آرڈر کرے گی تو اپیل کی جا سکتی ہے۔ جو کہ درج ذیل ہیں ۔

1.Under Section – 35A, ^{(Compensatory costs in respect of false or vexatious claims or defences)}

2. Under Section – 47 ^{(Questions to be determined by the Court executing decree)}

3.Under Section – 91 or 92 ^{(Public nuisances & Public charities)}

4.Under Section – 95 ^{(Compensation for obtaining arrest, attachment or injunction on insufficient grounds)}

یوں سول کورٹس کی ان سیکشنز کے تحت کئے گے آرڈرز کے خلاف اپیل کی جاسکتی ہے ۔ بس سیکشنز یاد رکھیں اورساتھ جرمانے اور گرفتاری کے آرڈرز پر اپیل کی جا سکتی ہے ۔

انکے علاوہ اگر کسی آرڈر میں عدالت جرمانہ کردے یا پھر ورنٹ گرفتاری نکال دے تو ایسے آرڈرز کے خلاف بھی اپیل کی جاسکتی ہے ۔ لیکن ۔۔۔ لیکن اس میں نوٹ یہ بھی ہے کہ اگر یہ آرڈر(جرمانہ یا گرفتاری) ایگزیکیوشن کورٹ نے ایگزیکیوشن آف ڈگری کیلئے دیا ہو تواس کے خلاف اپیل نہیں کی جا سکتی ۔

آخر میں یہی بتلایا گیا ہے کہ مثال کے طور پراگر آپکو جرمانہ ایک لاکھ ہوا ہو اس دینا بھی چاہ رہے ہیں لیکن اگر آپ اپیل کر دیں کہ میں لاکھ نہیں دے سکتا آپ مجھ سے پچاس ہزار لے لیں تو اسطرح کی اپیلیں بھی نہیں کی جا سکتیں ۔

سوال : کیا آرڈر کے خلاف جو اپیل ہوئی اس کے خلاف بھی اپیل ہے۔ مطلب ایک اپیل کے خلاف سیکنڈ اپیل ہو سکتی ہے ؟
Answer: Appeal against the Appeal is not available.

CPC Section 104 (Bare Act Text ⭐)

104. Orders from which appeal lies.– (1) An appeal shall lie from the folowing orders, and save as otherwise expressly provided in the body of this Code or by any law for the time being in force from no other orders:–
     (a) *****
     (b) *****
     (c) *****
     (d) *****
     (e) *****
     [(f) an order under section 35A;
     (ff) an order under section 47;
     [(fff) an order under section 91 or section 92 refusing leave to institute a suit;
     (g) an order under section 95;
     (h) an order under any of the provisions of this Code imposing a fine or directing the arrest or detention in the civil prison of any person except where such arrest or detention is in execution of a decree;
     (i) any order made under rules from which an appeal is expressly allowed by rules.
     [Provided that no appeal shall lie against any order specified in clause
     ⁵[(f)] save on the ground that no order, or an order for the payment of a less amount, ought to have been made.]
     (2) No appeal shall lie from any order passed in appeal under this section.
