Cr.P.C. Chapter 1 (Preliminary Definitions)

Chapter 1 of Criminal Procedure Code 1898 consisted on five sections from Section 1 to 5 . Each section discuss the preliminary definitions of Cr.P.C. Criminal Procedure Code 1898 was passed on 22 March 1898 and was enforced on 1 July 1898.


اس چیپٹر کے 5 سیکشنز ہیں جن میں سے سیکشن 2 کو تو ویسے ہی ختم کر دیا گیا باقی 4 سیکشن ہیں ۔ جن میں سے سیکشن 3 میں ججز کیلئے اصلاحات استعمال کی گئی ہیں جو کہ اتنا اہم نہیں ہے لیکن آپ میں سے کسی کا کوئی سوال ہو تو کمنٹس سیکشن میں بیان کر دیں ۔ باقی سیکشن 4 اور 5 زیادہ اہم ہیں ۔ بس انکو تھوڑا بہت سٹڈی کر لیں ۔ ہینٹس میں کچھ پوائینٹس بیان کیئے جا رہے ہیں وہ ذہین نشین کر لیں ۔

Non-cognizable Case
ایسا جرم جس میں پولیس بغیر وارنٹ کے گرفتاری نہیں کر سکتی۔

16. Public Prosecutor سیکشن 492 کے تحت مقرر کردہ شخص جو ریاست کی جانب سے مقدمہ چلائے۔
17. Sub-divisionmeans a sub-division of a district.

Section 5:

Under section 5 The Code of Criminal Procedure 1898 deals with trial of offences under other laws and under Pakistan penal code (PPC)

دراصل سیکشن 5 میں بیان کیا گیا ہے اگر کوئی قانون کسی خاص جرم کے لیے کوئی خاص طریقہ بتاتا ہے تو ہم اس خاص طریقے کو استعمال کریں گے، چاہے وہ جرم کسی اور قانون کے تحت بھی آتا ہو۔ لیکن اگر کوئی خاص قانون نہیں ہے تو ہم عام قانون (جیسے کہ کوڈ آف کریمینل پروسیجر) کے مطابق کارروائی کریں گے۔۔

مثال: اگر انسدادِ دہشت گردی قانون کے تحت جرم ہے، تو اس کی تحقیقات، تفتیش اور مقدمہ بھی دہشت گردی قانون کے تحت ہو گا، مگر اگر مقدمہ انسدادِ دہشت گردی قانون میں دہشت گردی کرائم کیلئے انویسٹیگیشن کا طریقہ کار فراہم نہیں کیا گیا تو پھر (سی آر پی سی ) کے تحت ہی انویسٹیگیشن ہو گی۔
