Section 75 cpc – Power of the court to issue commission

This section deals with the authority or power of the court to appoint a commission, also known as a local commission. Since the court cannot reach every place every time, it often appoints a commission for the following reasons:

1. Examination of Person: This means when a person is ill, elderly, or a veiled woman who cannot come to court, the court can appoint a commission for their examination.
2. Local Investigation: The court can appoint a commission for local investigation.
3. Adjustment & Examination of Accounts: When there is a need to audit the accounts of a bank, and the court doesn’t have the time for it, the court has the authority to appoint a commission.
4. Partition: In cases where there is a matter of dividing land, a house, or property, the court can also appoint a commission for that purpose.

یہ سیکشن عدالت کا ”کمیشن”یا (لوکل کمیشن) مقرر کرنے کے حوالے سے دائرہ اختیار یا پاور کے ساتھ ڈیل کرتا ہے۔ کیونکہ وہ ہر دفعہ ہر جگہ نہیں پہنچ سکتی پھر عدالت زیادہ تر کمیشن ہی بناتی ہے وہ وجوہات درج ذیل ہیں۔
1۔ Examination of Person : مطلب جب کوئی شخص بیمار، بوڑھا ہو، کوئی پردہ دارعورت ہو یا کوئی سرکاری ملازم جوعدالت نہیں آ سکتا ان سب کیلئے عدالت کمیشن مقرر کر سکتی ہے۔
2۔ Local investigation: لوکل انویسٹیگیشن کیلئے بھی عدالت کمیشن مقرر کر سکتی ہےمثال کے طور پر سول سوٹس کیلئے۔
3. Adjustment & Examination of Accounts: جب بینک کے اکاؤنٹس کا حساب کتاب کرنا ہو یا پھر کسی پراپرٹی کی ویلیو کرنا ہو تو عدالت کو یہ اختیار ہوتا ہے کہ وہ کمیشن مقرر کر دے۔
4۔ Partition: جب کسی زمین، گھر یا جائیداد کی تقسیم کا معاملہ ہو تو اس کیلئے بھی عدالت کمیشن مقرر کر سکتی ہے
