Section 75 cpc – Power of the court to issue commission


This section deals with the authority or power of the court to appoint a commission, also known as a local commission. Since the court cannot reach every place every time, it often appoints a commission for the following reasons:

  1. Examination of Person: This means when a person is ill, elderly, or a veiled woman who cannot come to court, the court can appoint a commission for their examination.
  2. Local Investigation: The court can appoint a commission for local investigation.
  3. Adjustment & Examination of Accounts: When there is a need to audit the accounts of a bank, and the court doesn’t have the time for it, the court has the authority to appoint a commission.
  4. Partition: In cases where there is a matter of dividing land, a house, or property, the court can also appoint a commission for that purpose.
