Section 47 of the Civil Procedure Code 1908 addresses questions arising during the enforcement of court decrees. When the court issues a decree, many questions and problems may arise during its implementation. This section addresses resolving all questions arising during the implementation of the court decree.
Notes on section 47(1) of cpc :
یہ سیکشن “ڈگری” ہونے کے بعد کے معاملات یعنی کہ یہ” ڈگری اجراء ”کے متعلق ڈیل کرتا ہے ۔
مطلب مدعی سوٹ فائل کرتا ہے پھر اس پر شہادت ہوتی ہے اور آخر میں کورٹ اپنا فائنل فیصلہ سناتی ہے جس کو ڈگری کہتے ہیں اور ڈگری پاس کرنے والی کورٹ کو ”ایگزیکیوٹنگ کورٹ” کہتے ہیں ۔
اسطرح یہ سیکشن عدالت کے ”ڈگری” پاس ہونے کے بعد کے معاملات جس میں ڈگری پر عمل درآمد کرنا ہوتا ہے کے ساتھ ڈیل کرتا ہے ۔
اگر اُس ڈگری پر عمل درآمد ہونے کے دوران کوئی سوالات/پیچیدگی پیدا ہو جائے تو اُن سوالات کو اُسی” ایگزیکیوٹینگ کورٹ ” نے ہی ڈیسائیڈ کرنا ہوتا ہے اس کیلئے پلینٹف/ ڈیفینڈینٹ اُسی کورٹ میں درخواست دے سکتا ہے وہ اُس کیلئے علیحدہ سے سوٹ فائل نہیں کر سکتا ۔
اس ڈگری کی ایگزیکیوشن ، ڈسچارج یا پھر اس ڈگری کی سیٹسفیکشن کی حوالے سے سوالات و جوابات ان پارٹیزکے درمیان یا انکے نمائندوں/وکلاء کے درمیان ہی ہونی چاہئیں ۔
All questions arising between the parties to the suit in which the decree was passed,or their representatives, and relating to the execution, discharge or satisfaction of the decree, shall be determined by the Court executing the decree and not by a separate suit.
Points;
وہ تمام سوالات جو ڈگری کی ”ایگزیکیوشن” ڈسچارج ” یا ”سیٹیسفیکشن” کے حوالے سے ہوں گے انکو ایگزیکیوٹنگ ” کورٹ ہی ڈیسائیڈ کرے گی۔
Notes on section 47(2) of cpc :
سیکشن 47 سب سیکشن 2 اس کورٹ کی دائرہ اختیار پر اعتراض کے متعلق ہے ۔
اس میں اگر کوئی اعتراض کرتاہے کہ” معزز کورٹ کو یہ کیس سننے کا اختیار ہی نہیں ”۔ تو کورٹ اس کے اس اعتراض کو ایذ اے ”سوٹ ” پروسیڈنگ کر سکتی ہے۔
یوں ا گرکورٹ اس اعتراض کو ایذ اے”سوٹ” پروسیڈنگ کرتی ہے تو پھر کورٹ اس ”سوٹ” پر ایڈیشنل کورٹ فیس کا بھی کہہ سکتی ہے۔
Because the term “may” is used here, indicating that the court has the discretionary power to charge an additional court fee.
س۔ کیا عدالت ایگزیکیوشن میں ایڈیشنل کورٹ فیس طلب کر سکتی ہے ۔

س۔ کیا عدالت ”سوٹ” کو ”ایگزیکیوشن” اور ”ایگزیکیوشن ” کو ”سوٹ” میں بدل سکتی ہے؟

س۔ کیا ”ایگزیکیوشن” کے لیے علیحدہ سے ”سوٹ” فائل کیا جا سکتا ہے؟

The Court may, subject to any objection as to limitation or jurisdiction, treat a proceeding under this section as a suit or a suit as a proceeding and may, if necessary, order payment of any additional court-fees.
Notes on section 47(3) of cpc :
اس سیکشن میں اگر کسی شخص کے بارے میں اختلاف کیا جاتا ہے کہ فلاں شخص کو جو پارٹی بنایا گیا ہے اس کا اس دعویٰ کے متعلق دور دور تک تعلق ہی نہیں یہ ایسے ہی پارٹی بن گیا ہے۔ تو اس کا فیصلہ بھی کورٹ ہی کرے گی کہ اس کا اس دعویٰ کی ساتھ تعلق ہے بھی کہ نہیں ۔
Where a question arises as to whether any person is or is not the representative of a party, such question shall, for the purposes of this section, be determined by the Court.
Section 47 Explanation:
وہ فریقین جن کا نام کیس سے خارج کر دیا گیا ہو، وہ بھی ایگزیکیوشن کے لیے “فریق” ہی مانے جائیں گے
a plaintiff whose suit has been dismissed and a defendant against whom a suit has been dismissed, are
parties to the suit.
Short Revision Hints
- 47(1) Bar to Suit: Execution, discharge, or satisfaction issues are decided only by the executing court; no new case is allowed.
- 47(2) Conversion: The court has the power to convert a suit into an execution proceeding or exection proceeding into a suit if needed.
عدالت ایگزیکیوشن کی کارروائی کو سوٹ میں یا سوٹ کو ایگزیکیوشن میں تبدیل کر سکتی ہے۔ اور اضافی کورٹ فیس بھی طلب کر سکتی ہے۔ - 47(3) Representatives: The executing court itself decides who the legal representatives of the parties are.
- 47 Explanation. Dismissed Parties: Even if a party was dismissed from the original case, they remain “parties” for execution purposes.
