Cr.P.C Chapter 5 (Of Arrest, Escape and Retaking )

CRPC Chapter 5 addresses the matters of arrest, escape, and retaking. Chapter 5 covers Sections 46 to 67 of the Code of Criminal Procedure, 1898.


Arrest :

اس چیپٹر میں ”اریسٹ” کو دو بنیادی طریقوں سے بیان کیا گیا ہے ۔ ایک ‘جنرل اریسٹ ‘ جسے سیکشن 46 تا 53 میں بیان کیا گیا ہے۔ جبکہ دوسری ‘اریسٹ وید آؤٹ ورنٹ ‘ ہے جسکو سیکشن 54 ٹو 67 تک بیان کیا گیا ہے اور انہی سیکشنز میں ” فرار(ایسکیپ) ” اور” دوبارہ گرفتاری (ریٹیکنگ)” کو بھی بیان کردیا گیا ہے ۔ ان میں سیکشن46 کچھ اہم ہے اسکو ٹیبل سے ہٹ کر بیان کیا جا رہا ہے


Section 46:

سیکشن 46 کا خلاصہ : سیکشن 46 دراصل گرفتاری کے دوران پولیس افسر کے اختیارات کے بارے میں بتاتا ہے۔ یہ بتاتا ہے کہ پولیس افسر کس طرح کسی شخص کو گرفتار کر سکتا ہے اور اگر ملزم مزاحمت کرتا ہے تو پولیس کیا اقدامات کر سکتی ہے۔ سب سیکشن 1: یہ حصہ بتاتا ہے کہ پولیس افسر کو کسی شخص کو گرفتار کرنے کے لیے اسے جسمانی طور پر پکڑنا ضروری ہے، جب تک کہ ملزم خود ہی گرفتاری کے لیے رضامند نہ ہو۔ سب سیکشن 2: یہ حصہ بتاتا ہے کہ اگر ملزم گرفتاری کا مقابلہ کرتا ہے یا فرار ہونے کی کوشش کرتا ہے تو پولیس افسر اسے قابو کرنے کے لیے ضروری تمام اقدامات کر سکتا ہے۔ سب سیکشن 3: یہ حصہ بتاتا ہے کہ پولیس افسر کو کسی بھی شخص کو مارنے کا حق نہیں ہے جب تک کہ وہ کسی ایسے جرم کا ملزم نہ ہو جس کی سزا موت یا عمر قید ہو۔ (اکثر پولیس اسی سیکشن کا سہارا لے کر انکوئنٹر کرتی ہے۔ )
