Section 498The power to direct admission to bail or reduction of bail (Powers of High Court and Sessions Court)ہائی کورٹ یا سیشن کورٹ کسی بھی مقدمے میں ملزم کو ضمانت پر رہا کرنے کا حکم دے سکتی ہیں یا ضمانت کی رقم کم کر سکتی ہیں۔ ہر بانڈ کی رقم کیس کے حالات کو مدنظر رکھتے ہوئے مقرر کی جائے گی اور حد سے زیادہ نہیں ہوگی۔
Section 498-ANo bail to be granted to a person not in custody, in Court or against whom no case is registered, etcاگر کسی شخص کے خلاف کوئی مقدمہ نہیں چل رہا ہے اور وہ جیل میں نہیں ہے تو عدالت اسے ضمانت پر رہا نہیں کر سکتی (مطلب اگر کسی شخص پر کوئی کیس نہیں تو اسکو ضمانت کس بات کی) ۔ اگر عدالت کسی شخص کو ضمانت پر رہا کرتی ہے تو یہ صرف اس مقدمے کے لیے ہی ہوگا جو اس شخص کے خلاف چل رہا ہے۔
Section 499Bond of accused and suretiesضمانت پر رہا کیے جانے والے شخص کو پولیس یا عدالت کی طرف سے دی گئی اطلاع پر مقررہ اوقات اور مقامات پر حاضری یقینی بنانا ہوگی۔ اس میں ہائیکورٹ اور سیشن کورٹ یا دیگر عدالتیں بھی شامل ہیں ۔
Section 500Discharge from custodyجب کوئی شخص ضمانت دیتا ہے تو اسے فوری طور پر رہا کر دیا جائے گا۔ اگر وہ جیل میں ہے تو عدالت جیل کو حکم دے گی کہ اسے رہا کر دیا جائے۔ تاہم، اگر اس شخص کو کسی دوسرے جرم کی وجہ سے قید ہونا ہے تو اسے رہا نہیں کیا جائے گا۔
Section 501power to order sufficient bail when that first taken is insufficientاگر عدالت سمجھے کہ پہلے جو ضمانت دی گئی ہے وہ فراڈ یا غلطی کی وجہ سے نا کافی ہے تو عدالت دوبارہ مناسب ضمانت طلب کر سکتی ہے اگر وہ نہ جمع کروا سکے تو گرفتارکر کے جیل بھیجا جا سکتا ہے ۔
Section 502Discharge of suretiesاس سیکشن میں بتلایا گیا ہے کہ ضامن عدالت سے اپنی ضمانت نامہ واپس لینے کا مطالبہ کر سکتا ہے ایسی صورت میں عدالت اگر مناسب سمجھے تو ملزم کو اور ضمانت دینے کا وقت دے سکتی ہے اگر وہ ایسا نہ کر سکے تو عدالت اسکو گرفتار کر سکتی ہے ۔
