Professional Ethics – Conduct with regard to other Advocates

The conduct of advocate with regard to other Advocates are outlined under the rule 134 to 144 of Canons of Professional Conduct and Etiquettes of Advocate. Under which the principles of relationship between lawyers have been clarified. This chapter specifically instructs lawyers to follow mutual respect and professional ethics, with the aim of promoting mutual respect and decency in the legal profession.

139موکل کی طرف سے اضافی وکیل کی تقرری کو اعتماد کی کمی نہیں سمجھا جانا چاہیے، اور پہلی تقرری شدہ وکیل کے واجبات ادا کیے بغیر نئے وکیل کو شامل نہیں کیا جا سکتا۔
140مقدمے میں وکلاء کے درمیان ذاتی جھگڑے اور توہین آمیز رویے سے گریز کیا جائے، اور موکلین کے درمیان موجود تنازعہ کو وکلاء کے تعلقات پر اثر انداز نہ ہونے دیا جائے۔
141فیس کی تقسیم صرف دوسرے وکیل کے ساتھ کام کے اصولوں کے مطابق ہونی چاہیے، جو کہ وکلاء کے معاہدے کے تحت ہو۔
142اٹارنی جنرل اور ایڈووکیٹ جنرل کی پیشگی کے علاوہ بار کونسل کے رول کے مطابق وکلاء کی پیشگی کا احترام کرنا وکیل کا فرض ہے۔
143جونیئر وکلاء کو ہمیشہ سینئر وکلاء کا احترام کرنا چاہیے اور سینئر وکلاء کو جونیئر وکلاء کی مدد اور رہنمائی کرنی چاہیے۔
144ایک سے زیادہ وکیل کی تقرری کی صورت میں سینئر وکیل کو مقدمے کی قیادت کا حق حاصل ہوتا ہے اور جونیئر وکلاء کو اس کی معاونت کرنی چاہیے جب تک کہ سینئر اس سے مختلف نہ چاہے۔

Rule 134. Duty of Every Advocate

  • Every advocate must:
    ➥ Maintain the dignity and high standards of the legal profession.
    ➥ Uphold their own dignity as a member of the profession.

Article 135. Soliciting Professional Employment

• An advocate shall not:
➥ Solicit professional employment by advertisement or any other means.

• This clause does not prohibit:
➥ The publication or use of ordinary professional cards.
➥ The use of name plates or conventional listing in directories.

• The information must be limited to:
➥ Professional and academic qualifications.
➥ Public offices currently held.
➥ No matter that suggests personal advertisement.

Article 136. Employment of Others For Soliciting Professional Employment

  • An advocate shall not:
    ➥ Employ any other person to solicit or obtain professional employment.
    ➥ Remunerate another person for soliciting or obtaining professional employment for him.
  • An advocate shall not:
    ➥ Share with an unlicensed person any compensation arising from professional employment.
    ➥ Aid or abet an unlicensed person to practice law or to receive compensation.
  • An advocate shall not knowingly:
    ➥ Accept professional employment offered as a result of the activities of an unlicensed person.

Article 137. Communication about a subject of controversy

  • An advocate shall not:
    ➥ Communicate about a subject of controversy with a party represented by another advocate.
  • This prohibition applies:
    ➥ In the absence of the other advocate.
    ➥ Without the consent of the other advocate.

Article 138. Communication With Judge or Judicial Officer

  • An advocate shall not:
    ➥ Communicate with or argue before a judge or judicial officer in the absence of the opposing counsel.
  • This communication is only permitted:
    ➥ In open Court.
    ➥ Upon the merits of a contested matter pending before the judge or judicial officer.
  • An advocate must:
    ➥ Provide the opposing advocate with a copy of any written communication addressed to the judge or judicial officer concerning the merits of a contested matter.
  • This rule does not apply to:
    ➥ Ex parte matters.
    ➥ Matters not sub judice before the judge or judicial officer.

Article 139. Client’s Offer Of Assistance Of Additional Advocates

  • A client’s offer of assistance:
    ➥ Should not be seen as evidence of a lack of confidence in the current advocate.
    ➥ The determination of such assistance should be left to the client.
  • An advocate must:
    ➥ Decline to associate with additional advocates as colleagues.
    ➥ Ensure that the dues of the advocate already retained are paid first.

Article 140. Clients Are The Litigants

  • Clients, not advocates, are the litigants.
  • Advocates must:
    ➥ Not allow any ill-feelings between clients to influence their conduct.
    ➥ Maintain professionalism towards each other and the parties involved in the case.
  • Personal clashes between advocates should:
    ➥ Be scrupulously avoided.
    ➥ Not include references to personal history or peculiarities of advocates on the other side.
  • Personal discussions that cause delay and promote unseemly wrangling should:
    ➥ Be carefully avoided.

Article 141. Division Of Fees

  • No division of fees for legal services is proper:
    ➥ Except with another advocate.
    ➥ Based on the principle of division of work as per the agreement between advocates.

Article 142. Order Of Precedence

  • Advocates must:
    ➥ Uphold the order of precedence as established by constitutional usage and practice.
    ➥ Follow the roll of advocates maintained by the Bar Council.

Article 143. Respect Among Members

  • Junior and younger members should:
    ➥ Always show respect to senior and elder members.
  • Senior members are expected to:
    ➥ Be courteous and helpful to junior and younger brethren at the Bar.

Article 144. Leadership In Cases

  • When more than one advocate is engaged on any side:
    ➥ The senior member has the right to lead the case.
    ➥ Junior members should assist the senior unless otherwise indicated.
