Chapter 17: Offences Against Property

This chapter deals with the offences against property, and Sections 378–462 of the Pakistan Penal Code 1908 deal with this chapter.


یہاں کچھ چار اہم سیکشنز ہیں انکو پہلے بیان کیا جا رہا ہے۔ باقی سیکشنز کو انکے بعد بیان کیا جائے گا ۔ جو کہ مکس سیکشنز ہی ہوں گے۔

Section 378 :Theft (table)

Section 378 : TheftMoveable property without Consent
منقولہ جائیداد کو بغیر اجازت اٹھا لینا ۔
Section 379 اگر گھر کے باہر سے چوری کرے گا تو 379 لگے گی ۔ جسکی سزا 3 سال ہے
Section 380 اگر گھر کے اندر سے چوری کرے تو 380 لگے گی ۔ سزا 7 سال
Section 381 اگر آپکا کوئی بھی کلرک یا ملازم چوری کرتا ہے تو اس پر 381 لگے گی ۔ سزا 7 سال
Section 381-Aاگر کوئی گاڑی یا موٹروائیکل جس میں سکوٹر ، سائیکل یا ٹریکٹر وغیرہ شامل ہیں چوری کرتا ہے تو اس پر 381-اے لگے گی ۔ سزا 7 سال
اس میں صرف 379 کی صورت میں 3 سال سزا ہے باقی سب میں 7 سال کی سزا ہے ۔

Section 383 : Extortion (table)

Section 383 : Extortion Moveable + Immovable = Without free consent
ایکسٹارشن دراصل بھتہ خوری ہی ہوتی ہے جسمیں کسی کو ڈرا دھمکا کر اس سے
موایبل یا اموایبل پراپرٹی کو حاصل کیا جاتا ہے ۔
Section 384 سزا 3 سال + جرمانہ

Section 390 : Robbery (table)

Section 390 : Robbery Robbery there is either theft or extortion.
instant fear of Hurt or Death
روبری یا تو چوری یا پھر ایکسٹارشن ہو سکتی ہے جسمیں اسٹینٹ ڈیتھ یا ہرٹ کا خوف موجود ہوتا ہے ۔
Section 392: Punishment for Robbery قید مشقت کم سے کم 3 سال زیادہ سے زیادہ 10 سال + جرمانہ
(اگر ہائی وے تے یکی کرے گا تو سزا 14 سال تے جرمانہ علیحدہ)
Section 393 : Attempt to commit robbery قید مشقت 7 سال + جرمانہ
قید مشقت = Rigorous imprisonment

Section 391 : Dacoity (table)

Section 391 : Dacoity When five or more persons conjointly commit or attempt to commit a robbery is said to commit “dacoity”
یوں 5 یا 5 سے زیادہ لوگ
Section 395 : Punishment for Dacoity قید مشقت 4 سے 10 سال
Section 398 : Attempt to commit Dacoity with weapon ڈکیتی کرنے کی کوشش کرنا ۔ قید مشقت کم سے کم 7 سال
Section 399: Preparation to commit Dacoity Rigorous imprisonment which may extend to 10 years.


Section 415 : Cheating (table)

Section 415: Cheating deceiving any person, fraudulently or dishonestly
property : Moveable + immoveable
مطلب کسی بھی شخص کی موایبل یا اموایبل پراپرٹی جو کہ فراڈ یا بےایمانی سے حاصل کی جائے
Section 420 سزا 7 سال + جرمانہ

Section 425 : Mischief (table)

Section 425: Mischief intentional act
نقصان پہنچانے کا ارادہ
Section 427 اگر کوئی ارادتاََ کسی کو 50 روپے سے زیادہ کا نقؔصان پہنچائے گا تو اسکو 2 سال تک کی سزا ہو سکتی ہے + جرمانہ
Section 428 اس سیکشن کے تحت اگر کسی جانور کو نقصان پہنچایا جائے تو سزا 2 سال تک ۔
Section 435 Explosive fire
آگ کے ذریعے گاڑی ، فصل وغیرہ کو 100 سے زیادہ کا نقصان پہنچانا ۔ سزا 2 سے 10 سال
Section 436 Explosive fire to House
سزا کم سے کم 3 زیادہ سے زیادہ 10 سال
دراصل میس چیف میں نقصان کے لحاظ سے مختلف سزائیں ہیں ۔ کم سے کم 3 ماہ کی ہے جو کہ سیکشن 326 میں بیان کی گئ ہے اور ایک بات یاد رکھیں نقصان پہنچانے کا ارادہ ضرور ہونا چاہئے۔

Section 441 : Criminal trespass Whoever enters into or upon property in the possession of another with intent to commit an
offence
مطلب بغیر اجازت کسی کی پراپرٹی میں داخل ہونا ۔

نقب زنی۔ مطلب گھر میں نقصان کیلئے داخل ہونا
Section 447 Punishment for Criminal trespass
سزا 3 ماہ
Section 448 Punishment for Criminal House trespass

Section 457Lurking house-trespass or house-breaking by night
مطلب رات کو کسی کے گھر داخل ہونا یا نقب زنی کرنا ۔ سزا 5 سال

Section 468: Forgery (table)

Section 468 : Forgery make false documents
جاہلی ڈاکومینٹس بنانا ۔ اس میں سزا زیادہ سے زیادہ 7 سال
Section 469 : Forgery for respect کسی کی بے عزتی کیلئے جاہلی ڈاکومینٹس بنانا ۔ سزا 3 سال
Section 489-F : Dishonestly issuing a chequeCheque dishonor .
