Chapter 16 (Complaints to magistrate)

Criminal Procedure Code 1898 Chapter 16 starts from Sections 200 to 203. In this chapter, only four sections are included. This chapter discusses an important topic: complaints to magistrates. Through these sections, we are able to understand the procedure for complaints to magistrates.


چیپٹر 16 میں عدالت کے سامنے شکایت درج کرنے کے طریقہ کار کی وضاحت کی گئی ہے اس چیپٹر میں صرف چار سیکشنز کو بیان کیا گیا ہے ۔


Important points;

  1. A Magistrate shall examine the complainant upon oath.
  2. After examination, the complainant and the Magistrate must sign the complaint.
  3. A Magistrate isn’t required to examine the complainant before transferring the case under Section 192.
  4. If the complaint is written by a Court or public servant , no examination is needed.
  5. If a written complaint is made and the Magistrate is not competent, he shall return it. If not written, he shall direct the complainant to the proper Court.
  6. If any inquiry or investigation is made by a person not being a Magistrate shall exercise all the powers conferred by an officer-in-charge of a police station.
  7. The Court may dismiss the complaint then he must briefly record its reasons.

201Procedure by Magistrate not Competent to Take Cognizance of the Caseاگر مجسٹریٹ کے پاس کیس کو سماعت کرنے کا اختیار نہیں ہے، تو وہ کیس کو اس مجسٹریٹ یا عدالت کو بھیجے گا جو اس کیس کو سننے کا اختیار رکھتا ہے۔ اگر کیس قابل سماعت (کونیزیبل) نہیں ہے، تو مجسٹریٹ شکایت واپس کر سکتا ہے۔
202Postponement of Issue of Processمجسٹریٹ کسی جرم کی شکایت پر سمن جاری کرنے سے پہلے تفتیش (انکوائری) کا حکم دے سکتا ہے تاکہ شکایت کی صداقت کی تصدیق ہو سکے۔ مجسٹریٹ شکایت کی تصدیق کرنے کے بعد ہی ملزم کے خلاف کاروائی کا حکم دے گا۔
203Dismissal of Complaintاگر مجسٹریٹ شکایت کی ابتدائی تحقیقات یا تفتیش (انوئیسٹیگیشن) کے بعد اس نتیجے پر پہنچتا ہے کہ کیس میں کوئی جواز (سبسٹانسز) نہیں ہے، تو وہ شکایت کو مسترد (ڈس مس) کر سکتا ہے۔ شکایت کے مسترد ہونے کی وجوہات کو تحریری طور پر بیان کرنا ضروری ہے۔
